The Level III grievance was dismissed by the School Board at the June 8,
2010 School Board meeting based on the recommendations of the fact finders
report to the School Board. All remedies requested by the employee were
granted. Thanks to all that supported this process.

Mr. Juan Montoya, Director of the Public Employee Labor Relations Board,
in a letter dated June 2, 2010 stated, "I have reviewed the pleadings and
listened to the audio record of the hearing on the Motion to Dismiss
(filed by Los Alamos Public Schools). Based on that review of the record
I find that the Union has raised enough of a question that the Los Alamos
Public Schools has violated PEBA in that it failed to negotiate in good
faith as to teacher's duties. The Los Alamos Public Schools Motion to
dismiss is hereby denied."

Mr. Montoya has retired from his position as director of the Labor
Relations Board effective June 30, 2010. His replacement has not been
assigned. In the meantime, the Union is waiting for the recommendation of
the school district regarding the next step in this process. I will post
on the web site information as it becomes available.
